Some information about Missouri uninsured motorist coverage law:
The Missouri Uninsured Motorist (UM) provision states that a motor vehicle liability policy shall insure the named insured and any other insured person using the named motor vehicle, motor vehicles, or other covered vehicle with the express or implied permission of the named insured, against loss from the liability imposed by law for the damages arising out of the ownership, maintenance or use of the motor vehicle or motor vehicles with a minimum of $25,000 because of bodily injury to or death of one person in any one accident; a minimum of $50,000 because of bodily injury to or death of two or more persons in any one accident; and a minimum of $10,000 because of injury to or destruction of property of others in any one accident. See R.S.Mo. § 303.190(2). Additionally, Missouri Statutes provide that an automobile liability insurer may not issue liability insurance based on the ownership, maintenance, or use of any motor vehicle unless coverage is offered for the protection of the insureds who are legally entitled to recover damages from owners or operators of uninsured motor vehicles because of bodily injury, sickness or disease, including death, resulting therefrom. See R.S.Mo. § 379.203.1.
If any valid provisions of the UM statute are excluded from the original insurance contract, they are written in as if they were a part of the original contract. Ward v.Allstate Ins. Co., 514 S.W.2d 576 (Mo. Banc 1974). What this means, as a practical matter, is that if your auto insurance policy does not provide you with all of the coverage defined by Missouri statutes (specifically 379.203)
